Terms of Service

These Terms of Service ("Terms") govern your access to and use of TenantFix.app (the "Service"), a WhatsApp-based AI maintenance and rental management bot provided by Totalremoto LLC ("we," "us," or "our"), registered in Wyoming, USA. By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
The Service is powered by Polsia AI. By using the Service, you also agree to Polsia's Terms of Service, Privacy Policy, and Subprocessors list. In case of conflict, these Terms prevail except where Polsia's terms specifically govern AI processing.
The Service integrates with WhatsApp Business API. Your use must comply with Meta's WhatsApp Business Terms of Service, WhatsApp Business Solution Terms, and WhatsApp Business Messaging Policy.
1. Eligibility
You must be at least 18 years old and capable of forming a binding contract to use the Service. You represent that you are authorized to bind any entity (e.g., landlord or property management company) on whose behalf you use the Service.
2. Accounts and Registration
To use the Service, you must register an account via our website and provide accurate information (e.g., email, phone number linked to WhatsApp). You are responsible for maintaining the security of your account credentials. Notify us immediately of any unauthorized access. We may suspend or terminate accounts for violations of these Terms.
3. Description of Service
TenantFix.app is a SaaS platform that enables landlords and tenants to manage maintenance requests, rentals, inventory, reminders, and related tasks via WhatsApp. Features include AI triage for repairs, document uploads, searchable dates, and integrations. We reserve the right to modify or discontinue features at any time.
4. Subscription and Payments
Pricing
Subscription fees vary by region:
- $29 USD/property/month (USA)
- £29 GBP/property/month (UK/Ireland)
- $39 CAD/property/month (Canada)
- $39 AUD/property/month (Australia)
- €29 EUR/property/month (other Europe)
Billed monthly via Stripe. Prices may change with notice. Volume discounts available for 10+ properties.
Payment
You authorize recurring charges to your provided payment method. Overdue payments accrue interest at 1.5% per month or the maximum legal rate. If payment fails (e.g., due to insufficient funds or expired payment method), we will attempt to retry the charge. If the failure persists after reasonable attempts, we will suspend your access to the platform and the tenants' access to the platform until payment is resolved.
Refunds
No refunds except as required by law or our money-back guarantee (if applicable, e.g., 14 days for new users).
Taxes
You are responsible for all applicable taxes.
5. User Content and Responsibilities
You may upload content (e.g., leases, photos, documents) to the Service. You retain ownership but grant us a worldwide, non-exclusive license to use, store, and process it to provide the Service. You represent that your content complies with laws and does not infringe third-party rights.
Prohibited Conduct
Do not use the Service to:
- Violate laws (e.g., tenant rights, data protection)
- Send spam or unsolicited messages
- Upload harmful content (e.g., viruses)
- Harass or discriminate
- Reverse-engineer the Service
- Violate WhatsApp policies (e.g., use only approved message templates for outbound communications)
Compliance
Ensure all WhatsApp interactions obtain user opt-in consent and adhere to Meta's rules. We are not liable for your misuse.
6. Intellectual Property
We own all rights to the Service, including AI models (powered by Polsia) and software. You are granted a limited, revocable license to use the Service during your subscription. Do not copy, modify, or distribute any part without permission.
7. Data Privacy
Your data is handled per our Privacy Policy. As the Service uses Polsia and WhatsApp, their privacy terms apply to relevant processing. We use subprocessors (see Polsia's list) for AI and messaging. You consent to data transfers as needed for the Service.
8. Termination
We may terminate or suspend your access for violations, non-payment, or at our discretion with notice. Upon termination, you must cease use and pay outstanding fees. Sections surviving termination include IP, disclaimers, and limitations of liability.
9. Disclaimers and Limitations of Liability
THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES. WE DISCLAIM ALL IMPLIED WARRANTIES (E.G., MERCHANTABILITY, FITNESS FOR PURPOSE). WE ARE NOT LIABLE FOR INDIRECT DAMAGES (E.G., LOST PROFITS, DATA LOSS) OR AMOUNTS EXCEEDING FEES PAID IN THE PRIOR 12 MONTHS. THIS APPLIES TO THE MAXIMUM EXTENT PERMITTED BY LAW.
10. Indemnification
You agree to indemnify us against claims arising from your use of the Service, content, or violations of these Terms.
11. Governing Law and Dispute Resolution
These Terms are governed by Wyoming law (USA), without regard to conflicts. Disputes shall be resolved via binding arbitration in Wyoming under AAA rules, except for small claims. For users in the UK, Ireland, Canada, or Australia, nothing in these Terms affects your statutory rights under local consumer laws.
12. Changes to Terms
We may update these Terms with notice (e.g., email or in-app). Continued use constitutes acceptance.
13. Miscellaneous
- Force Majeure: No liability for delays due to uncontrollable events.
- Severability: Invalid provisions do not affect the rest.
- Entire Agreement: These Terms supersede prior agreements.
